Federal Judge Orders Release of Kilmar Abrego Garcia from ICE Custody
A court has ruled the immediate discharge of Kilmar Abrego Garcia from immigration custody, concluding his continued detainment lacks legal authority.
"Since his release after erroneous imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis stated in her order.
The case stems from a erroneous removal to El Salvador in March, which US authorities later admitted was an error. After his return to the United States to answer human smuggling allegations, he was held in immigration detention.
In her decision, the court pointed out that the government does not have a valid deportation order, which effectively blocks them from deporting Mr. Abrego Garcia "for now."
Background of the Legal Challenge
The court challenge center on conflicting claims. While the former administration contends that Abrego Garcia is a member of the MS-13 gang, he categorically denies this allegation.
He has also pleaded not guilty to the conspiracy counts, which are part of a separate criminal case in the state of Tennessee.
Conditions of Freedom
The judge, who was hearing his challenge to removal in a federal court, ruled that he must now adhere to the terms of his release from custody in Tennessee. This order effectively transfers his monitoring to the Tennessee court.
This decision marks a notable development in a complicated legal battle featuring allegations of wrongful detention and disputed criminal affiliations.
